Privacy Policy

We protect your privacy and your personal data. Our processing of personal data of individuals who contact us is limited to data necessary for providing our services, maintaining and developing our business, and ensuring the functionality of our website. We collect, process, and use your personal data exclusively in accordance with the content of this Privacy Policy and applicable data protection regulations, in particular the Swiss Federal Act on Data Protection (FADP) and the Federal Ordinance on Data Protection (FADP). This Privacy Policy governs which personal data we collect, process, and use about you. We therefore ask you to read the following information carefully.

By disclosing your data to us, in particular by contacting us, entering into a contract with us or using our website, you consent to the data processing described here and in particular to the processing of data abroad (see section 8).

1. Responsible person

Bike Academy Davos GmbH (hereinafter referred to as "we" or "dealer") is, as the owner of the bicycle shop and operator of the website bike-academy.ch, responsible for the personal data of customers and users of the shop's website (hereinafter referred to as "you" or "customer") within the meaning of the GDPR.

2. Principles of data processing

When processing data, we take into account the processing principles of lawfulness, proportionality, purpose limitation, transparency – in particular the fulfillment of information obligations – and data security.

3. Intended use in general

We use your personal data in aggregate for the following purposes:

  • To fulfill our obligations arising from any contracts concluded between you and us, to prepare the conclusion of the contract, and to process payments.
  • To be able to provide you with the products, services and information you request in physical and digital form.
  • To ensure that we can present our website to you in the most effective and interesting way possible.
  • To inform you about news and changes to our services.
  • To enable you to participate in interactive offers (e.g. newsletters), should you wish to do so.

We describe in detail which data we process and for what purpose in the following sections of this privacy policy.

4. Description and scope of data processing
4.1. Type of personal data processed

Personal data within the meaning of the Data Protection Act is all information relating to an identified or identifiable natural person (hereinafter referred to as "data subject").

When you conclude a contract or create a customer account on our website, we collect the following personal data from you: your name and gender, your email address, your address(es), and your telephone number(s). To process a purchase in our online shop, we also collect data on the chosen payment method, such as credit card or bank account details.

Personal data also includes information about your use of our website. In this context, we collect the following data in particular: the IP address of the device you use to access our website (hereinafter referred to as "your IP address"), the location from which you access data from our website, your usage behavior on our website (which parts of the website you access), and other connection data and resources that you access. This is generally done through the use of log files and cookies. You can find more detailed information about this in sections 5 to 8 of this privacy policy.

The processing of your personal data depends on the intention with which you contact us (e.g. interest in purchasing or simply obtaining information on the website) and the communication channels used for this purpose (e.g. in person in the store, via the website or other communication channels such as e-mail or telephone). You can find further information about this in the following sections of this data protection declaration.

4.2. General Communication

When you contact us – whether in person, via our website, or through other means – we process the data you provide in this context that is necessary for handling your request, in particular any customer history stored in our industry software. In addition to the data you provide, we process – depending on the nature of your request – the following personal data: name, address, email address, telephone number, and information on previous contracts.

Data from this communication will be stored, if at all, in our industry-specific software and, in the case of communication via email or the contact form on our website, on our mail server. In this context, we would like to point out that data transmission on the internet, particularly communication via email, can have security vulnerabilities, and complete protection of data against access by third parties is not possible.

4.3. Data processing during contract conclusion in general

As part of the contract process (purchase, repair, or other services), we create a customer account for you in our industry-specific software. This account stores and processes your name, gender, address, telephone number(s), email address, the contract details, work performed by us, and billing information. For contracts related to e-bikes, we also process data from your e-bike (e.g., during e-bike servicing, we analyze error codes recorded by the operating system).

We process this data for the following purpose:

  • To verify the prerequisites for concluding a contract.
  • To fulfill our contractual obligations to you.
  • For address validation or updating your contact details.
  • For invoicing, debt collection purposes and for creditworthiness and solvency checks.
  • To prevent the unlawful use of our services, in particular to prevent fraud when concluding contracts via our website.
  • To nurture, develop, and maintain our relationship with you.
  • To personalize our offerings or provide personalized content, e.g., by conducting research regarding demographics, usage patterns, and customer interests.
  • For the promotion, design and further development of our products and services.

4.4. Transfer of data to manufacturers, suppliers or forwarding companies

For processing individual customer orders, direct delivery of products to you, or handling any damage or warranty claims, personal data (name, contact and address details, contract data such as the serial number of the bicycle or e-bike, date of purchase, etc.) may be forwarded to manufacturers, suppliers, service partners, or shipping companies both domestically and internationally. Data shared in connection with individual customer orders may be used by the manufacturer or supplier to maintain, develop, and preserve the customer relationship, to personalize services, or to provide personalized content. By concluding such a contract, you expressly consent to the disclosure of the aforementioned data to the manufacturer, supplier, or shipping company, as well as its transfer abroad if the manufacturer, supplier, or shipping company has a foreign location.

4.5. Disclosure of data when concluding an insurance policy or making installment payments

If you arrange insurance or installment payments in conjunction with the purchase of a bicycle, e-bike, or other product, we will forward your data to the insurance or credit company providing this service. This typically includes the following data: name, address, telephone number(s), email address, date of birth, and nationality/place of origin. These companies may use your data for the purposes described in section 4.3 above. By concluding such a contract, you expressly consent to the disclosure of the aforementioned data to the insurance or credit company.

4.6. Transfer of data to the road traffic office when purchasing a fast electric bicycle

When you purchase an e-bike with pedal assist up to 45 km/h, we may forward your data (name, address, date of birth, copy of your ID, foreign resident permit or driver's license, vehicle make and model, and chassis number) to the road traffic office responsible for your area for the issuance of a vehicle registration document and the vignette with group insurance. By purchasing an e-bike, you consent to the transfer of your data to the road traffic office.

4.7. Additional data processing when concluding a contract via our webshop

If you wish to conclude a contract via our online shop (webshop) on our website, you can create a customer account. If you do not want your personal data to be collected in our webshop, select the option "Order without registration". In this case, your data will only be processed in our industry software to fulfill the contractual obligations. In addition to the aforementioned data processing, payment processing via the webshop requires data processing by the third-party company you select for payment of your purchase.

5. Data processing when using our website
5.1. Data processing by the retailer

When you access our websites, the following data is stored in log files: your IP address, date, time, browser request, and general information about the operating system and/or browser. The status and the amount of data transferred during this request are also recorded. We also record which website you are accessing our site from. If we collect your IP address, it is stored only for the duration of your website visit and is then immediately deleted or anonymized by truncation.

We use this data to operate our website, in particular to identify and correct website errors, to determine website usage, and to make adjustments or improvements. This usage data also forms the basis for statistical, anonymous analyses, allowing us to identify trends and improve our services accordingly.

5.2. External Links

Despite careful review of the content, we assume no liability for the content of external links on our website. The operators of the linked websites are solely responsible for their content and compliance with data protection laws.

5.3. Data processing by third parties

External plugins, scripts, and embedded images, videos, and iframes extend the functionality and content of our website. Because this content is loaded from external websites, customer-related data may be transmitted to the operators of these external websites (hereinafter referred to as "services"). This data includes, in particular, your IP address, the date, time, and duration of access, browser requests, and general information about your operating system and/or browser. Some services also use cookies (see section 5.4), which allow customers to be tracked and recognized across different websites.

As the provider of our website, we have no knowledge of the data collected or processed by these services. Likewise, we have no knowledge of, nor any influence over, which specific data these services process and for what purposes they use your data. However, we would like to inform you below about the services we have integrated and where you can find further information about their data processing practices.

5.3.1. Google Maps

Our website uses the Google Maps API to visually display geographical information. When using Google Maps, Google Inc., based in the USA, also collects, processes, and uses data about customers' use of the map functions.

5.3.2. Trekksoft

We operate the booking tool on our website using Trekksoft (TrekkSoft AG, Matten near Interlaken). When you visit our website or use the booking tool, Trekksoft may collect customer-related data (see section 4.2 above) as well as the data you enter during the booking process.

5.3.3. App-room

We operate the booking tool on our website with CYCLE (app-room GmbH, Dättwil AG). When you visit our website or use the booking tool, customer-related data (see section 5.3 above) and the data entered during the booking process may be retrieved by CYCLE.

5.4. Cookies
5.4.1. General

We use cookies on our website. Cookies help in many ways to make your visit to our website easier, more pleasant and more meaningful. Cookies are information files that your web browser automatically saves to your computer's hard drive when you visit our website. Through the information stored and sent back in the cookie, our website recognizes if you have already accessed and visited it with your web browser. However, only the cookie itself is identified on the end device. Any further storage of personal data will only take place if you give us your express consent or if this storage is absolutely necessary in order to be able to use the service offered and accessed. Cookies can also be set by external services (Google Analytics or AdWords, newsletter providers).

We use cookies, for example, to display the website optimally according to your preferences. We also use cookies to temporarily save your selected services and entries when filling out a form on the website, so that you don't have to re-enter the information when visiting another page. 5.4.3.1. Strictly necessary cookies

Strictly necessary cookies ensure that our website functions correctly. This means that without these cookies, this website cannot be used as intended. These types of cookies are used exclusively by us as the website operator (first-party cookies), and all information stored in the cookies is only sent to our website.

The following strictly necessary cookies are used on our website:

Strictly necessary cookies cannot be individually disabled or enabled. However, you can disable cookies in general in your browser at any time (see section 7.4 below). Please note, however, that in this case you may not be able to fully utilize all the functions of this website.

5.4.3.2. Analytics and statistics cookies

Analytics and statistics cookies collect information about how our website is used in order to improve its attractiveness, content, and functionality. These cookies help us, for example, to determine whether and which subpages of our website are visited and which content is of particular interest to customers. The number of visits to a page, the number of subpages viewed, the time spent on our website, the sequence of pages visited, the search terms that led customers to us, the country, region, and, if applicable, the city from which access is made, as well as the proportion of mobile devices accessing our website. For technical reasons, the IP address of a computer is transmitted but automatically anonymized, preventing us from identifying individual customers. We do not store any information that would allow customer identification.

5.4.3.3. Marketing and third-party cookies

Marketing and third-party cookies are used to display targeted advertisements that are relevant to the customer and tailored to their interests. They are also used to limit the frequency with which an ad is shown and to measure the effectiveness of advertising campaigns. They register whether a website has been visited or not. This information can be shared with third parties, such as advertisers. Cookies for improving audience targeting and advertising are often linked to third-party website functionalities.

5.4.4. Disabling or deleting all cookies

If you generally do not wish to use browser cookies, you can configure your browser to reject cookies or to ask you each time whether you agree to the setting of cookies. You can delete cookies that have already been set at any time in your web browser. Instructions for this can be found in your web browser's help function.

Please note that in this case, you may only be able to use our website to a limited extent or not at all. If you only want to accept our own cookies, but not those of our service providers and partners, you can select the "Block third-party cookies" setting in your browser. You can also partially reject cookies from our website in your cookie settings.

6. Newsletter

By subscribing to our newsletter, you provide your email address and can optionally enter your name. Furthermore, your IP address and the date of registration are also stored during the registration process; the latter is solely for evidentiary purposes in the event of fraudulent registration.

We use Brevo from Sendinblue GmbH, based in Germany, to send our newsletter. The data collected during registration is encrypted and transmitted to Brevo, where it is stored. After registration, Brevo will send you an email to confirm your subscription. Brevo also offers various analytics tools to track how our newsletters are opened and used, such as how many customers received an email, whether emails bounced, and whether customers unsubscribed after receiving an email. However, these analytics are only aggregated and are not used by us for individual analysis.

Brevo also uses the Google Analytics analysis tool from Google Inc., based in the USA, and may integrate it into our newsletters (see section 5.4.3.2 below).

If you do not want analysis by Brevo or Google Analytics, you can refuse your consent to receive newsletters or unsubscribe from the newsletter. For this purpose, we provide you with a corresponding link in every newsletter. Furthermore, you can inform us directly at any time that you no longer wish to receive the newsletter.

7. Data security

We protect your data through appropriate technical and organizational security measures. Specifically, we protect your data against unauthorized access, accidental or intentional manipulation or misuse, destruction, and loss. Our data processing and security measures are continuously improved in line with technological developments.

For security reasons and to protect the transmission of confidential information, our website uses SSL/TLS encryption. You can recognize an encrypted connection by the fact that the browser's address bar changes from "http://" to "https://" and by the padlock icon in your browser's address bar. When SSL/TLS encryption is activated, the data you transmit to us cannot be read by third parties.

However, we would like to point out that data transmission on the internet can have security vulnerabilities. Therefore, complete protection of data transmitted via our website or by email from access by third parties is unfortunately not possible.

8. Data Retention

Your data processed by us will be stored on servers within Switzerland, unless expressly stated otherwise below.

  • Our email correspondence is stored on a server in Germany.
  • Our website with integrated webshop (see in particular section 4.7 above) stores your data in Germany.
  • Our newsletter (see section 6 above) stores your data in Germany.

Collected personal data will be deleted no later than ten years after it was collected. This does not apply to personal data if it is necessary to fulfill an ongoing legal obligation or contractual relationship, or to assert, exercise or defend legal claims.

9. Your personal data will not be shared.

We do not disclose your personal data to third parties unless you have consented to the data transfer (see in particular sections 4.4 – 4.6 and 6 above) or we are authorized or obligated to disclose the data due to legal provisions or official or court orders. This may include, in particular, the disclosure of information for the purposes of law enforcement, prevention of danger, or enforcement of intellectual property rights.

10. Changes to this Privacy Policy

We reserve the right to amend this privacy policy at any time with effect for the future. The current version is available on our website or in our store.

11. Your rights

You have the right to request information about your personal data processed by us at any time.

You also have the right to request the correction of your personal data stored by us. Furthermore, you have the right to revoke any consent you may have given for the use of your personal data at any time for the future and to request the deletion of this data, insofar as it is no longer required by us to fulfill a legal obligation or to establish, exercise or defend legal claims.

If you believe that our processing of your personal data is in violation of applicable data protection regulations, you also have the option of lodging a complaint with the Federal Data Protection and Information Commissioner (FDPIC).
